This is an appeal from a summary judgment of the District Court for defendant-appellee, hereinafter called Licensee, in a declaratory judgment action brought for the construction of a patent license agreement and for other affirmative relief. Jurisdiction rests upon the diversity of citizenship of the parties to this action, which involves an amount in excess of the minimum prescribed by 28 U.S.C.A. Â§ 1332. The jurisdictional foundation also includes the provisions of Â§ 2201 of the same Title.
